Terms and Conditions

These Terms and Conditions ("Terms") govern access to and use of the EAN Studio service, provided by Brincadeiras100fim Unipessoal, Lda, Portuguese tax number (NIF) 514 561 408, with registered office at Rua da Portela, 413, 3700-894 Romariz, Portugal ("we", "us" or "EAN Studio").

By creating an account or using the service, you accept these Terms in full. If you do not agree, you must not use EAN Studio.

1. Service description

EAN Studio is a web application that lets you generate, verify and manage barcodes (EAN-13, UPC-A, QR Code, GS1-128, among others), organize product catalogs and create label layouts for printing. The service is available at ean-studio.com.

The technical ability to generate a barcode in EAN Studio does not, by itself, grant the right to use it in the global supply chain or in retail. For that purpose, the product number (GTIN) must be assigned to you through a company prefix licensed by GS1 or an equivalent registration authority. EAN Studio is a generation and management tool and does not assign or license GS1 prefixes.

2. Eligibility

To create an account you must be at least 18 years old and have the legal capacity to enter into contracts. By accepting these Terms, you declare that you meet this requirement. The service is not intended for minors.

3. Plans and pricing

EAN Studio is available on the following plans:

Prices are shown in euros and include any applicable VAT or sales tax. The tax portion is calculated by our Merchant of Record (see section 4) according to your country; the total amount you pay remains the same regardless of country. Prices may change with 30 days' prior notice by email.

4. Subscriptions, payments and automatic renewal

Payments and billing for EAN Studio are processed by Lemon Squeezy LLC, which acts as Merchant of Record. This means Lemon Squeezy is the entity that processes the payment, issues the invoice and is responsible for collecting and remitting the applicable taxes in each country. By completing a subscription, you also accept the Lemon Squeezy terms and privacy policy applicable to that transaction.

Paid plans renew automatically at the end of each period (monthly or annual) unless cancelled before the renewal date. Cancellation can be done at any time through the subscription management portal provided by Lemon Squeezy, accessible after login. After cancellation, you keep access until the end of the period already paid for.

5. Right of withdrawal and refunds

If you are a consumer, you have the right to withdraw from the contract without giving any reason, within 14 days of the subscription date, under EU consumer law (and, for Portuguese consumers, Decree-Law No. 24/2014 of 14 February).

To exercise this right, simply notify us of your decision in an unequivocal statement, by email to geral@ean-studio.com, before the deadline. You may use the model form below, although it is not mandatory. We will refund all payments received within 14 days of being informed of your decision, using the same means of payment used for the purchase.

Digital content and services: when subscribing, you may request that the paid service begin immediately, during the 14-day period. In that case, by giving your express consent and acknowledging that you lose the right of withdrawal once the service has been fully performed, you accept that this right ceases to apply after full performance. If the service has only been partially performed when you exercise the right, you may be charged an amount proportional to what has already been provided. Outside the 14-day period, no refunds are issued for partial periods.

6. Acceptable use

When using EAN Studio, you agree to:

• Not use the service for illegal or fraudulent purposes.
• Not generate barcodes with false data intended to mislead consumers or scanning systems, nor use GTIN prefixes that have not been legitimately assigned to you.
• Not attempt to access features locked by technical means without authorization.
• Not reproduce, resell or sublicense the service without written permission.

We reserve the right to suspend or terminate accounts that breach these conditions, without refund.

7. Intellectual property

The code, design, brand and content of EAN Studio are the property of Brincadeiras100fim Unipessoal, Lda and are protected by copyright and other intellectual property rights. The barcodes and catalog data generated by the user belong to the user.

8. Service availability

We will make all reasonable efforts to keep the service available, but we do not guarantee uninterrupted availability. We may carry out scheduled maintenance, with prior notice whenever possible. We are not responsible for unavailability caused by third parties (cloud providers, network operators, etc.).

9. Limitation of liability

To the maximum extent permitted by applicable law, our total liability to you, for any cause, will not exceed the amount paid for the service in the 12 months prior to the event giving rise to the damage. We are not liable for indirect damages, loss of profits or loss of data. Nothing in these Terms excludes or limits liability that cannot be legally excluded, in particular for willful misconduct or gross negligence.

EAN Studio is a support tool — the final verification of the compliance of barcodes with GS1 or other standards, as well as the ownership of the numbers used, is the user's responsibility.

10. Changes to these Terms

We may update these Terms at any time. Material changes will be communicated by email at least 30 days in advance. Continued use after the effective date of the changes constitutes acceptance of the new Terms.

11. Governing law, dispute resolution and jurisdiction

These Terms are governed by Portuguese law. If you are a consumer, you always benefit from the mandatory consumer protection rules of your country of habitual residence in the European Union, which these Terms do not set aside.

In the event of a consumer dispute, you may turn to an alternative dispute resolution (ADR) entity. The competent entity in Portugal for general consumer disputes is the Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC). You may also consult the Portuguese Consumer Portal and file a complaint through the Electronic Complaints Book.

Without prejudice to the above and to the courts legally mandated for consumers, for all other disputes the court of the district of Aveiro shall have jurisdiction.
